10% Section 122 surcharge expires July 24, and what replaces it is still uncertain United States
What This Means: After the Supreme Court struck down all IEEPA tariffs on February 20, the White House imposed a flat 10% global surcharge under Section 122, effective February 24. It expires July 24 unless Congress extends it. USMCA-qualifying goods, CAFTA-DR textiles, and products already under Section 232 are exempt. The announced increase to 15% has never been formally enacted.
Why It Matters: The U.S. average effective tariff rate stands at 11.0%, the highest since 1943 excluding 2025. If Section 122 lapses without a replacement, rates drop significantly, but the administration is racing to have Section 301 tariffs ready by that date.

CBP's IEEPA refund system (CAPE) launches April 20. Action required. United States
What This Means: CBP’s new refund portal, CAPE, is on track for an April 20 launch. Phase 1 covers unliquidated entries and those liquidated within the past 90 days, roughly 63% of all entries where IEEPA duties were paid. Refunds are not automatic; importers must submit claims through ACE. CBP estimates up to 45 days from claim acceptance to refund delivery. Finally liquidated entries will be addressed in a later phase with no announced timeline.
Why It Matters: Over 330,000 importers paid IEEPA duties across 53 million entries totaling roughly $166 billion. Importers who don’t file claims won’t receive refunds. ACH enrollment is required because CBP no longer issues paper checks.

Written comments are due April 15. Hearings on forced labor begin April 28; hearings on overcapacity begin May 5. Treasury Secretary Bessent has indicated he expects tariff rates to return to their pre-SCOTUS levels once these investigations conclude.

These investigations are widely understood as the legal vehicle for rebuilding the IEEPA tariff regime under a different statute. What This Means: On April 8, President Trump announced via Truth Social that imports from any country supplying military weapons to Iran would face an immediate 50% tariff with no exclusions or exemptions. The announcement came hours after a two-week U.S.-Iran ceasefire was brokered. Trump did not specify which legal authority would be used, and analysts have noted the Supreme Court’s February IEEPA ruling limits his options. China and Russia are the most likely targets, though both have denied recently supplying weapons. No formal executive order or proclamation has been issued.
Why It Matters: The legal path for this tariff is unclear, and imposing new duties on China could complicate Trump’s planned visit to Beijing in mid-May. However, importers sourcing from China should treat this as a risk signal. If enacted, a 50% blanket tariff on Chinese goods would stack on top of existing Section 301 and Section 232 duties.
